Terms and Conditions
Last updated: 2 October 2026
These Terms govern your use of the SecIncyte platform, this website and any related services. SecIncyte is the unified cybersecurity platform from CyberVigilens. By requesting a demo, signing an order or deploying the platform, you accept these Terms. If you do not agree with them, please do not use the platform.
1. About SecIncyte
SecIncyte brings security operations into one place. It combines endpoint and agentless telemetry, SIEM, exposure and vulnerability management, identity and access governance, monitoring, automation, backup and response into a single console, so teams can move from signal to context and from context to action. The platform is offered by CyberVigilens. We are at 2nd Floor, 7-1-67/12, Dharam Karan Road, Near Nature Cure Hospital, Ameerpet, Hyderabad, Telangana 500 016, India, and you can reach us at sales@cybervigilens.com or on +91 9849004358.
“Customer”, “you” and “your” mean the organisation or person licensed to use the platform, and anyone who acts for them.
2. Licence and permitted use
Subject to payment of the applicable fees and to these Terms, we grant you a non-exclusive, non-transferable, revocable licence to install and use the SecIncyte software and to access the hosted services for your internal business purposes, for the subscription term and within the licensed scope, for example the number of endpoints, users or modules you have purchased.
You must not reverse engineer, decompile or disassemble the software except as the law allows; resell, sublicense or provide the platform as a service to third parties without our written consent; use the platform to monitor or test systems you are not authorised to monitor; remove or obscure proprietary notices; or use the platform in a way that breaks the law or the rights of others.
3. The platform is provided “as is”
The SecIncyte software, agent, collectors and hosted services are provided on an “as is” and “as available” basis. We do not warrant that the platform will be uninterrupted, timely, error-free or bug-free, that it will meet your requirements, or that it will work with every environment, device, operating system or third-party product. We make no express or implied warranty of merchantability, fitness for a particular purpose or non-infringement, and nothing in our marketing material should be read as such a warranty.
4. Detection, alerts and AI are assistive, not a guarantee
SecIncyte is a tool that helps skilled people do their work. It is not a substitute for your own controls, your own judgement or your own response, and it does not by itself make an environment secure.
- No security product, ours included, detects every threat. Detection depends on the telemetry, log sources and integrations you make available, and on threats behaving in ways our analytics can recognise.
- Alerts, findings, risk scores and prioritisation may contain false positives and false negatives. They are inputs to your review, not proof that an environment is safe or unsafe.
- AI-assisted summaries, diagnoses and automation outputs are assistance only. They are provided without warranty and must be reviewed by a competent person before you rely on them. Automation sessions run in Read-only or Actionable mode according to the permissions and settings you configure, and you decide whether to enable them.
- A clean dashboard or the absence of an alert is not evidence that no incident has occurred.
5. We are not an insurer
SecIncyte is software, and we are a software provider. We are not an insurance company, and the platform is not insurance. Nothing about the platform transfers your cyber risk to us. We do not pay for losses, and nothing in these Terms or in any proposal should be read as an undertaking to cover the financial consequences of a security incident.
6. Deploying the agent, licensing and decommissioning
The platform needs a valid licence and active support to keep working. You may deploy the agent only on endpoints and servers you are entitled to manage, and you must provide any notices or obtain any consents that apply to monitoring your users and systems.
When a licence or support subscription expires, is terminated or is not renewed:
- We may stop data collection and telemetry from your environment.
- You are solely responsible for uninstalling and removing all SecIncyte agents, drivers, background services and scripts from your endpoints and servers, and for the orderly decommissioning of edge or management servers.
- We are not liable for anything that follows from agents or components you leave behind, including lingering processes, resource consumption, instability, crashes or unpatched components.
7. Your responsibilities
You remain responsible for your own environment at all times. In particular, you agree to:
- Deploy and operate the platform lawfully, including any employee-monitoring notice, consent or consultation required by the law that applies to you.
- Keep at least one recent, offline, immutable backup of your critical data, disconnected from the network, and test your ability to restore it.
- Patch and update your systems, and maintain the configurations the platform depends on.
- Maintain an accurate asset inventory, and provide valid, least-privilege credentials and access for any agentless or integration-based coverage.
- Review and act on the alerts, findings and recommendations the platform surfaces, and keep your environment within supported versions.
- Confirm that you have the legal right to collect and process the data you feed into the platform.
If you do not carry out these responsibilities, the visibility and protection the platform can provide is reduced, and we are not responsible for problems that result.
8. Agentless access, cloud and third-party integrations
Some coverage is agentless, using SNMP, SSH, Redfish, cloud provider APIs and vendor consoles, and some modules depend on third-party services. These integrations depend on the target systems and on third parties we do not control. Coverage is best-effort. Vendor API changes, firmware updates, credential expiry, network restrictions or third-party outages can reduce or interrupt coverage, and we are not liable for a third party’s failure to provide or maintain its interface. Third-party products remain governed by their own terms and warranties.
9. Data, telemetry and privacy
You and your organisation own the data you place in the platform and the telemetry collected from your environment. We process that data to provide, support, secure and improve the platform, and we handle it with reasonable care. You are responsible for having a lawful basis to collect and process the data you send us, for any monitoring of individuals, and for retaining it in line with your own obligations. Do not use the platform to conduct unlawful surveillance. When your subscription ends, your data is returned or deleted as agreed or as the law requires.
10. Availability, support and updates
Hosted availability, monitoring and support are provided on a best-effort basis unless a separate written service level agreement applies to your subscription. We may release updates, patches and new versions, and may add, change or withdraw features from time to time. Where a feature is withdrawn, we will try to give reasonable notice and, where practical, a supported alternative.
11. Fees and payment
Fees, licensing metrics, billing cycles and payment terms are set out in your order. Unless stated otherwise, fees are exclusive of applicable taxes, which are added as required by law. If an invoice is overdue we may suspend or terminate the licence after giving you notice, and we will not be liable for consequences that follow from a suspension caused by non-payment. Fees are non-refundable except where these Terms or the law say otherwise.
12. Limitation of liability
This section is important, and we ask you to read it carefully.
To the maximum extent permitted by law, and except where the law does not allow exclusion or limitation:
- We are not liable for any indirect, incidental, special, punitive, exemplary or consequential loss or damage, or for any loss of profit, revenue, business, goodwill, opportunity, anticipated savings, data or use, however it arises, whether or not it was foreseeable, and whether the claim is in contract, tort (including negligence), statute or otherwise.
- We are not liable for extortion or ransomware payments, regulatory fines or penalties, third-party claims, or the cost of substitute services.
- Our total aggregate liability for all claims arising out of or in connection with the platform, whether in contract, tort or otherwise, is limited to the total fees actually paid by you to us for the affected platform subscription in the twelve (12) months immediately before the event that gave rise to the claim.
- Where your use is a free trial, proof of concept, evaluation or pilot, or where no fees have been paid, our total aggregate liability is nil (zero).
These limits apply even if a remedy fails of its essential purpose, and they extend to our directors, officers, employees, agents and subcontractors. They do not apply to our fraud or wilful misconduct, or to any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence where such limitation is not permitted.
Nothing in these Terms excludes or limits any right you may have that cannot be excluded or limited under the applicable law.
13. Changes to these Terms
We may update these Terms from time to time to reflect changes in the platform, the law or business practice. When we do, we post the updated version here and change the date at the top. If the changes are significant, we will try to tell you directly. Continuing to use the platform after a change takes effect means you accept the updated Terms. If you do not agree, please stop using the platform and tell us in writing.
14. Force majeure
We are not liable for a failure or delay caused by events beyond our reasonable control. These include natural disasters, flood, fire, earthquake, pandemic, war, civil unrest, terrorism, government action, failure of the internet or telecoms, large-scale cloud or data-centre outages, and widespread cyber attacks on infrastructure we do not control. If such an event delays us for more than 90 days, either of us may end the affected subscription on written notice.
15. Term and termination
Your subscription runs for the term in your order. Either party may terminate as allowed in that order. We may suspend or terminate immediately if we believe your use breaks a law, breaches our terms with a third party, or puts our staff, systems or other customers at risk, and we will tell you why. On termination, your licence ends, you must stop using the software and remove the agents as set out in section 6, and access you gave us should be revoked promptly.
16. Governing law and jurisdiction
These Terms and any dispute arising from them are governed by the laws of India. The courts at Hyderabad, Telangana have exclusive jurisdiction, unless applicable law requires otherwise.
